These Terms of Use ("Terms") govern your use of [WEBSITE URL] (the "Site"), operated by Lawsuit Help ("we," "us," or "our"). By using the Site or submitting information through it, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
PLEASE READ SECTION 12 CAREFULLY. IT CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT HOW DISPUTES BETWEEN YOU AND US ARE RESOLVED.
1. Attorney Advertising — We Are Not a Law Firm
This Site is an advertisement. Lawsuit Help is a marketing service, not a law firm, and does not provide legal advice. We do not recommend or endorse any particular attorney. Using the Site or submitting a form does not create an attorney-client relationship with us or with any law firm. An attorney-client relationship is formed only if a law firm agrees in writing to represent you. We do not guarantee that any attorney will review or accept your case, or that you will receive any compensation. Prior results do not guarantee a similar outcome.
2. Eligibility
You must be at least 18 years old to use the Site. If you submit information about a minor child, you represent that you are that child's parent or legal guardian and are authorized to act on the child's behalf.
3. Information You Submit
You agree that all information you submit is true, accurate, and complete, and that the name, email address, and phone number you provide are your own. You may not submit information about another person unless you are legally authorized to do so. We may reject or discard any submission at our discretion.
4. How Your Information Is Shared
To help you find out whether you may have a claim, we share the information you submit, which may include information about health conditions, with our marketing partners, including law firms and legal service providers, who may contact you about your potential claim. Our Privacy Policy describes our practices in more detail.
5. Consent to Be Contacted
By submitting a form on the Site, you give the consent to be contacted shown on that form. This includes consent for Lawsuit Help and its marketing partners to contact you about your potential claim by phone, text message, or email at the number and address you provided, including through automated technology such as autodialers and pre-recorded or artificial voice messages, even if your number is on a state, federal, or corporate "Do Not Call" list. Consent is not a condition of any purchase or of receiving services.
You may withdraw your consent at any time by any reasonable means, including replying STOP to any text message, asking the caller to stop calling you, or emailing help@lawsuit-help.com. Reply HELP to any text message for help. Message frequency varies. Message and data rates may apply. Your carrier is not liable for delayed or undelivered messages.
If your phone number changes, is reassigned, or is disconnected, you agree to notify us promptly at help@lawsuit-help.com.
6. Consent to Electronic Records (E-SIGN)
You agree that we may provide notices, disclosures, and other communications to you electronically, and that your electronic submission, including clicking a submit button, is your electronic signature and has the same legal effect as a handwritten signature under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and applicable state law. You may withdraw consent to electronic communications by emailing help@lawsuit-help.com. To access these communications you need a device with internet access and a current web browser. You may print or save a copy of these Terms at any time.
7. Consent Records
To document your consent and help prevent fraud, we keep a record of each form submission, including the date and time, your IP address, your device and browser information, the page you submitted from, and the consent language shown to you.
8. Acceptable Use
You agree not to: submit false, fraudulent, or misleading information; submit information on behalf of someone you are not authorized to represent; use bots, scripts, or automated means to access or submit information to the Site; interfere with the Site's security or operation; or use the Site for any unlawful purpose.
9. Intellectual Property
The Site and its content, design, text, graphics, and logos are owned by or licensed to Lawsuit Help and are protected by intellectual property laws. You may not copy, reproduce, or distribute any part of the Site without our written permission.
10. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the Site will be uninterrupted or error-free, and we are not responsible for the services, advice, or conduct of any law firm or other third party you are connected with through the Site.
11. Limitation of Liability and Indemnification
TO THE FULLEST EXTENT PERMITTED BY LAW, LAWSUIT HELP AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify and hold harmless Lawsuit Help from any claims, losses, or expenses (including reasonable attorneys' fees) arising from information you submit or your violation of these Terms.
12. Binding Arbitration and Class Action Waiver
Agreement to arbitrate. You and Lawsuit Help agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any communications you receive from us or our marketing partners, including claims under the Telephone Consumer Protection Act and similar state laws, will be resolved by binding individual arbitration rather than in court. Either party may instead bring an individual claim in small claims court if it qualifies.
Procedure. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, before a single arbitrator. Payment of filing and arbitrator fees will be governed by the AAA's rules. The arbitrator may award the same individual relief a court could award.
Class action waiver. YOU AND LAWSUIT HELP AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. YOU WAIVE ANY RIGHT TO A JURY TRIAL.
Opt-out. You may opt out of this arbitration agreement by emailing help@lawsuit-help.com within 30 days of first submitting information through the Site, with your name, phone number, and a clear statement that you opt out of arbitration.
Severability. If the class action waiver is found unenforceable, this entire Section 12 will not apply to that claim.
13. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted on this page with a new effective date. Your continued use of the Site after changes are posted means you accept them.
